NOTICE of LIABILITY RELEASE & WAIVER
By purchasing this Festival ticket and entering the Tottenham Conservation Area (“the Park”), I, the buyer of this Festival ticket, UNDERSTAND and AGREE, on behalf my minor children/ward(s), my heirs, my assigns, my personal representatives, and my next of kin, THAT I VOLUNTARILY ASSUME ALL RISKS associated with the Park use, Festival participation, and Festival programs used by ME or my minor children/wards; and I release all persons, organizations or corporations associated with the Festival, including sponsors, advertisers and funding bodies of the Festival or the Park, even if such claim arises from the negligence or gross negligence, (including any compounding or aggravation of injuries) caused by negligent rescue operations or procedures. By my entrance to the Festival, I confirm having notice of this waiver of liability, and I freely consent to a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of all persons, organizations or corporations, including sponsors, advertisers and funding bodies associated with the Festival, including, without limiting the generality of the foregoing, its officers, directors, officials, and/or employees; other participants, sponsors, advertisers, owners and/or lessors of the Park; sanctioning bodies, medical and/or rescue personnel, including but not limited to THE NOTTAWASAGA CONSERVATION AUTHORITY,THE TOTTENHAM BLUEGRASS FESTIVAL, THE TOTTENHAM-BEETON AND DISTRICT CHAMBER OF COMMERCE INC., THE SIMCOE COUNTY BLUEGRASS AND OLD-TYME MUSIC ASSOCIATION, and THE TOWN OF NEW TECUMSETH, ITS EMPLOYEES, ELECTED OFFICIALS, AGENTS, PARENTS, or INDIVIDUALS INVOLVED WITH THE FESTIVAL AS ORGANIZERS OR SPONSORS (“the RELEASEES”) of and from and with respect to all injury, disability, death, or loss or damage to person or property, whether arising from the negligence, gross negligence, or negligent rescue of or by the foregoing or otherwise, and agree to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fee, liability, damage, award of cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the RELEASEES or otherwise.
NO LIFEGUARD AND SWIMMING NOTICE
All persons are given notice that there are no lifeguards on duty, and that it is the responsibility of parents and/or guardians to monitor their minor children’s use of the water area, the children’s activities and programs, and all of other play areas within the Park.
NO LIABILITY FOR LOST OR STOLEN ARTICLES
Please lock-up and use protective devices to prevent theft or loss of items. The Festival and its partners or sponsors assume no liability whatsoever or howsoever caused for damaged, or stolen personal property.
YOUR PHOTO IMAGE AND LIKENESS WILL BE USED TOTTENHAM BLUEGRASS FESTIVAL
To avoid misunderstanding, we wish to give you notice that Tottenham Bluegrass Festival does intend to capture a photographic image or likeness of all event participants and will also retain the exclusive copyright to the use of the photographs or images (without exception), unless we are notified by you in accordance with this notice.
Tottenham Bluegrass Festival may be making a movie or taking photographs of the event for promotional, advertising and related commercial uses. Before you participate, we want you to be aware that Tottenham Bluegrass Festival, it’s sponsors, it’s agents, or other participants will take photographs, videos, or films of the event
For personal, promotional, advertising and related commercial uses. Your likeness may be used on the Tottenham Bluegrass Festival face book, website, newsletter or other similar type of social media. Therefore, by participation in the Tottenham Bluegrass Festival event, you are deemed to have consented to the use of your photographic likeness or image unless we are informed that you do not consent to its use. You need to notify Tottenham Bluegrass Festival in writing either prior to the end of the event, or within 30 days following the end of the event.
You must provide your name, address and phone contact information. You must also allow us photograph you, or provide a photograph of you in order to have your likeness excluded from any of the images.
All participants assume responsibility for exercising control and use of their campsites, shelters, or personal space to ensure a safe and controlled area for themselves and their own invitees and guests. As to COVID, we rely upon your good common sense and adherence to the health guidelines.
